A few weeks later as I called my insurance company to start processing my medical insurance claim, I was told they couldn’t prove that the accident hadn’t been my fault as I didn’t know the police report number (as I had been concussed when the police arrived, and the police were busy dealing with people much more messed up than I.) It was a harsh phone call, and left me very anxious having to recount my accident to someone that really didn’t feel like they cared or wanted to help me.
From there, I contacted Brian’s office and he immediately called me back. I quickly set up one meeting where I laid out the details and gave them some basic info. They were nice and chill and made me very very comfortable with the process. And that was it. I was able to continue to get treatment for the symptoms that popped up without having to worry about having to argue or deal with my insurance, and was just able to focus on getting myself back in shape.
Brian’s office was able to get me my full amount available under my policy. My first trip to the ER was also not covered by my medical insurance, so when I faulted on the payment to them I got a lien. Brian’s office also negotiated that lien WAY down and settled it up on my behalf.
I really just didn’t want to deal with any of this. Im not a litigious person, and talking about the accident at all does bring up lots of stress and anxiety. Not having to think about it, and knowing that I had a great team advocating and staying on top of everything on my behalf was a huge blessing.
I really hope no one has to deal with these kinds of issues, but I would highly recommend Brian and his team if you ever have to. He made something really awful not quite as bad.
My no-fault auto accident case was handled with very, I want to stress, VERY minimal work on my end. Brian handled everything from the filing the claim, to thoroughly searching the assets of the defendant, processing my UIM, dealing with Rowlie and even negotiating with Blue Shield of California to get a fair settlement out of the limited insurance limit available.
I also want to mention that he took my case even if the insurance limit was not a commercial limit but just above state minimum. Many attorneys out there refused to take my case because it wasn't "big enough" for them. The fear and vulnerability that came from having my independence and financial security taken away from me is what propelled me to google “best personal injury lawyers.” Mr. Breiter’s name was the first one that came up and I called him after reading multiple positive reviews. From our first point of contact he treated me with empathy, respect, and professionalism. During that initial time of upheaval and constant worry he not only guided me through the legal steps but he also reassured me and made recommendations that made the healing time more bearable. He totally had my back and we were in the process together.
In the first 9 months after the accident I went from using a walker, to crutches, and finally to a cane. One of the screws had to be surgically removed because it had started to work its way out of my leg and I could actually see it pushing against my skin from the inside out. At 10 months I could walk without the use of a cane so I was able to start working part time. It was another 3 months until I could get through a whole day without having to elevate and ice my leg and it would be years before the inflammation was gone for good.

A Toyota Tundra truck ran a two way stop sign and t-bone the driver side of my civic. Totaled in the process. Till today, I can still see and feel the heat from the grille from the truck. The driver not once did come by to check to see if I was ok, and had the nerve telling others that I was speeding when others said I was not. While the fire department was using the "Jaws of Life" cutting the door, my pregnant wife drove by and saw the accident with me in the car with a drape over me to protect me from the glass and debris, but you can imagine what she was thinking. So to say I was livid is an understatement and wanted the best possible team to handle the case.

The accident gave me 4 injured discs in my neck and bad daily chronic nerve pain (still ongoing) that affected my ability to drive, sit, sleep, care for myself, or have energy for anything else, as well as a broken foot. I had no idea who to go to for help, advice, or treatment. By Monday, Brian's team had an appointment for me with an orthopedic surgeon and physical therapy, and repair for our car.
I was given realistic information up front from Brian that these kinds of cases take time, and because of his many years of successful experience with personal injury cases, he gave me perspective on a likely progression of treatments that might be advised to me or I might want to seek out before surgery (which prepared me for the various neurosurgeon/ortho meetings I had and decisions I had to make). He also knows the best doctors in town. I began my long journey of meeting doctors, tests, MRIs, treatments, more PT, all of which I couldn't afford out of pocket initially until I got better insurance. Brian, Mark and the team negotiated great treatment on liens so I could continue to work on healing, which in itself is very stressful, and thoughts of what the future would bring physically and financially were very scary. Brian, Mark, Jeff, and team prepared us for the deposition (Jeff was with us and did an excellent job of advising and protecting us); they sent a nurse with me to support me during the defense doctor's examination to ensure that I would only have to answer the necessary questions. I'll be honest; these kinds of life changing events are really stressful, even with help. I can't imagine what it would have been like without Brian and his team. My brief story: I was hit by a car while biking, the car fled the scene. On top of the black eyes, contusions and bruises, probably a concussion, I also had a fractured arm. I was unhappy with the medical care I was receiving and was also afraid to even contact my insurances (I thought they might raise my rates, who knows). I really didn't even know who to call. The insurance company offered me a terrible valuation for my totaled car, mark and Brian actually got me double the initial offer from the insurance company, and made sure that the most important thing right off the bat was me getting the correct medical attention to get me feeling better.
Throughout the whole process these guys were pretty great, I would defiantly recommend Brian and mark to anyone. When there are a lot of guys out there that aren't willing to go the distance, these guys are!

On September of 2015 I was involved in a motor vehicle accident where a semi-truck crashed into me due to careless driving. I was a college student at the time and was halfway through my nursing program when this accident turned my life upside down. This crash left me with a totaled car, with a complete fractured wrist (my dominant hand) which needed two major surgeries, and forced me to withdraw from the nursing program for 6 months pushing back my graduation date. You can imagine how helpless I felt as all of this was unexpected and not in my control.

We started looking for a trial lawyer the day after my accident. On the morning of March 4th 2017, I went for my usual hike on the hills around my neighborhood! On my way back, as I was crossing the street (legally, with having the right of way) I was struck by a car. According to the witnesses, I was thrown several feet up in the air and then the driver ran over my leg like a speed bump! Both the tibia and fibula bones in my leg were broken in many places which required immediate surgery. The bones on my hand were also shattered which subsequently had to be operated on a couple of months later! As I was lying down in the hospital bed with so much pain, all kinds of drugs being pumped in my body, my wife and I realized that we would have to start searching for a lawyer immediately. My good friend immediately took me to the hospital. As we were in the waiting room, she contacted Brian. I met with both firms and was impressed with each of them. I had the misfortune to be rear-ended at a standstill for the second time within 2 years. I suffered greatly with many injuries including numerous spinal surgeries throughout the first accident, and , again with the second. Due to the accident, I had to take care of other things in my life and Brian made it much easier by handling basically every aspect of my case on his own without needing me for much, which left me free to take care of other adjustments I needed to make after the accident. From the beginning, he was very transparent and communicative regarding the case and how the process was going to be handled, communication with his office was almost instantaneous with every question I had answered promptly as well.
I've heard that in many cases these type of process take some time to be resolved, but Brian was able to settle my case in a few months, as well as dropping some of the costs from the hospital I was treated.

Quick background: Someone took a lot of photos of the accident scene, showing the car the person was driving was perpendicular in the middle of the suicide lane. It was clear he was in the middle of a U-Turn, which in that particular instance, was an illegal one. In light of this, it would seem obvious he was at fault.
The police report said no one was. In fact, it reported minor damage to my motorcycle (which was actually totaled). The other person made some ridiculous claims that I drove into the suicide lane to go around him as he "merged into the suicide lane". Keep in mind his car was literally side ways in middle of the lane. The officer on the scene bought it. Of course he also took no photographs because if he did his report would look ridiculous.
I was stressed because I read some google information that if the police report isn't in your favor then you're basically screwed.

My 85-year old mom was in a motor vehicle accident with an uninsured motorist. When I got to the scene of the accident, her car was already on the tow truck and she had the police report in her hand. She was shaken up and stressed but said she was fine and just wanted to go home so she could eat ice cream. I told her we should go to the ER but she said no, she just wanted to go home. Reluctantly I obliged though my gut told me that she should go to the ER as I knew that injuries may not be immediately apparent.

While shopping in a well known retail store, my 89 year old mother slipped and fell in a puddle of water and fractured her hip. THE ACCIDENT
In December 2014, my Wife and stay at home Mother of our three children (ages at the time 7, 4 and 1) went to a children's clothing sample sale at a Pilates studio. While squatting down sorting through a pile of clothing, a Pilates reformer (a 6'8" 38.5 lb bench) which was improperly secured came crashing down on her head. She remained conscious, but blacked out for a bit and "saw stars". At first we had no idea the severity of the injury, but after a few days of the symptoms (nausea, neck pain, blurred vision, loss of dexterity in hand, general confusion, inability to suffer light or noise, radiating pain down the arm, severe headaches and migraines) getting progressively worse we knew that this was a serious injury that needed immediate attention. After seeing a number of specialists my Wife was diagnosed with a Mild Traumatic Brain Injury (mTBI), and was put on a daily dosage of Nortriptalyne and given Maxalt for acute treatment of the Migraines. After the first six months a number of the physical symptoms had gone away with the exception of crippling migraines, she was still only a fraction of herself.
THE CASE
Again, we had no idea the extent of my Wife's injuries but knew we were going to need to retain legal counsel after I visited the Pilates studio where the accident occurred, and the Owner denied the accident happening. My Wife was suffering, our medical bills were adding up and now I have a sociopath calling me a fraud and promising to send my Wife and I to jail - this is when Brian became my friend and attorney. We went through two mediations (June and Sept 2016) with no reasonable offers being presented - we steel ourselves for trial with a date set for June 2017.
TRIAL
This is where Brian and his team (Partner - Steve Hoffman, Associate - Jeff Twomey) truly shone. Finally, on day 4 it was my turn to take the stand and tell our story, Brians direct line of questioning allowed for me to do just - many tears were shed. In spite of what I found to be underhanded tactics by Defense, the Jury unanimously sided with us awarding a verdict ten times what the Defense had proposed - justice was served.
All said it has been a wild 2.5 years, but can tell you at numerous times throughout my Wife and I both said thank g-d for Brian. He helped us through a difficult time, kept us laughing when we wanted to cry and ultimately delivered the best possible result from a terrible situation. I am usually reluctant to offer recommendations/referrals, but in this case I can wholeheartedly and without concern tell you that should you or a loved one find find yourself in a similar situation call the Law offices of Brian Breiter - you will not find a more caring or competent group
As the week went on, things got a bit worse. I was diagnosed with a concussion the next morning and proceeded to go downhill as the week continued. My husband watched me as I was unable to care for my three kids and didn't know what to do. Concussions were unchartered territory for us so he called an old friend Brian Breiter for guidance. Brian wouldn't give my husband, Adam, any legal advice at all, even though that's his area of expertise. He said there wouldn't be any discussion of legal terms until we figure out my medical situation as health comes first. He advised Adam to get me to the ER where then I was advised to go to a neurologist.

It was December and we all know how difficult it can be to get a doctor appointment at any time, let alone the holidays. Brian and Mark helped me get a neurologist appointment right away when any other doctor we called couldn't see me for months.
Over the last two years, from the first neurologist to other neurologists to psychologists and more, Brian has helped me get appointments with doctors that helped me get answers when it seemed as if there were no answers. He encouraged me to keep trying to get better when I just wanted to crawl into bed and give up. He helped me see that things will continue to get better when I felt myself falling back down. When he didn't have the answer I was looking for, he reminded me that it was probably time for me to go back to the doctor (I'm not usually a person who goes to the doctor often!). More often than not, he would make me laugh when I wanted to cry. Most importantly, Brian was always there with a gentle reminder that this can be a long process and not to give up.
That's just a part of what Brian did, he really did focus on my health first- because that's the kind of person he is. But the reality is, you are probably reading this review because you are interested in him as an attorney and this is where he shines above all.
We attempted several times to settle with the defense to no avail. Brian tried very hard to work with the other side to come to reasonable terms but throughout the entire process, that never happened. After three failed mediations, and listening to Brian's advice, we ended up going to trial. I was nervous heading into court but it turns out there is no one else I would rather have by my side during this entire experience.
In the courtroom, I sat with Brian Breiter, Jeff Twomey, and Steve Hoffman. Mr. Twomey is a very impressive young attorney with a great career ahead of him. Mr. Hoffman blew me away with his medical knowledge and his ability to depose and cross examine the medical experts in the case. He could "out-doctor" any doctor on the stand! Mr. Breiter kept the entire courtroom engaged, entertained, and informed during the entire six day trial. His opening statement and closing argument solidified why he's considered one of the best.
The jury, with only a short two hour deliberation, unanimously sided with us and awarded us more than ten times the amount that the defense ever offered in any mediation.
IF I HAD TO GO THROUGH THIS EXPERIENCE AGAIN, I'D WISH FOR THE SAME DREAM TEAM OF BRIAN BREITER AND HIS OFFICE
Recently the case was settled and I received a substantial compensation. My friend received a smaller settlement, but was not charged the contracted 40% legal fees.
I thought that it was going to be difficult to type a review because some leftover hands limitations-and the emotions attached, however, the biggest difficulty is finding the best words to describe the exceptional service we received from this firm.
Where do I begin?
Once out of the hospital the idea of getting involved in any litigations was terrifying. I was reluctant to start any legal case. I did not have the energy, and I was afraid, worry and very symptomatic after my neck emergency surgery and dealing with all medical providers
Finally, I realized that I needed to fight for my life and time was of 'the essence', and that it was better to be compensated than confronting the cost of life, and the possibility of more medical interventions or special care later.

In time, we got to know also lawyer Mark Rubaskin, and what a great attorney he is. In many instances, he counseled me to stay strong, when I was in pain and doubt and I wanted to quit everything and so overwhelmed that I wanted to settle early but he convinced me to the contrary.

Later, in the mid of the process, I read two depositions done by Brian taken and we were impressed with his concise articulation, his knowledge and arguments. He could spot weaknesses in the opposition and make it work to our benefit. It was clear that we were in good hands, and I stopped wanting to read more of the reports.
