I had three Trustees who refused to communicate or work with me on any level. They were rude, hateful, dishonest, and they did not care about me or my interest in the Trust. My trust was losing money month after month. I went to several lawyers for help and they told me that nothing could be done, and that I didn't have a case! I then met with Stewart Albertson at Albertson & Davidson, LLP and he accepted my case. Stewart helped me when no one else wanted to! After several years of aggressive litigation by Stewart and his team, he was able to get the three Trustees removed, not an easy thing to do under California law. A new trustee, receptive to my needs, was appointed. I will soon be receiving an outright distribution from the Trust. I can’t thank Stewart and his team enough for all they did for me. They take a personal interest in their clients, and genuinely care about them. They go above and beyond the call of duty. After my father died, I learned that an extended family member had taken advantage of him and caused him to create a trust three days before he died. The trust disinherited my sister and I, the only children of my father. I researched several law firms and came across Albertson & Davidson, LLP. I called them and explained the situation and they said they could help. They assigned our case to attorneys Stewart Albertson and Jeff Hall. Stewart and Jeff jumped on our case and immediately filed a trust contest to invalidate the fake trust that was created three days before my father died. Jeff took the drafting attorney’s deposition and uncovered facts that would make a reasonable attorney in the same position suspect undue influence was taking place over my father. Then, Jeff took one of the extended family member’s deposition who would gain by the trust. Jeff was able to uncover significant discrepancies in this extended family member’s story of how the trust was created. The opposing attorney in this matter stated in open court that his clients would never agree to mediate this matter prior to trial. But after Jeff’s deposition of the extended family member, the opposing attorney’s clients apparently had a change of mind and agree to a mediation. Stewart and Jeff appeared with my sister and I at the mediation. After a long day, and much back and forth, we were able to come to an agreement that made us believe we held the opposing side responsible for the creation of the trust, and provided an inheritance to us that we believe was intended to be made to us by our father. My sister and I are very happy with the representation we received from Albertson & Davidson, LLP and highly recommend them for trust and probate litigated matters.
