Our experience of their attorney, Samantha Pungprakearti is from the perspective of the "accused/defendant/stupid former employer".

She will fight hard for her client, finding and following up on every tiny technical error on the part of the employer and she will not rest until she has worn the employer down so hard they they either pay up or go bankrupt. She is like a dog with a bone! Unfortunately in my case, they did not do their due diligence by checking whether or not we or our business actually had any money!

Their client, Kalen Jennings, had behaved appallingly for several months culminating in her using foul language and threatening behavior towards her line manager, with witnesses, while I was sitting at my mother's death bed! I had no choice other than to fire her, I was concerned for the safety of my employees as well as the dogs in her care. Ms Pungprakearti willfully ignored all the mitigating circumstances and went for the jugular of our small dog walking business in the hopes of a windfall! This kind of lawyer is the worst kind of parasite, they take on hapless small businesses, shake them down and run off with as much money as they can get, but since we were broke we are all losers!

The fact that I hadn't made my staff of seven people sign in and out and that we had not docked Kalen's pay when she showed up late for work every day and then paid her overtime when she sometimes worked a few minutes late, is apparently wrong and they would have won at trial. Having been questioned by Samantha Pungprakearti under oath for 5 hours in a deposition, it became clear that they were not going to leave us or our business alone; because of the signing in and out thing and California law being so anti the employer, it was clear we would be found guilty and even if the award to Kalen was only a few hundred dollars, I would have to pay Ms Pungprakearti's fees: but I don't have any money!

The actions that Ms Pungprakearti and her client took meant that my business, the business I had spent ten years and all my savings building up had to go into liquidation before the trial, this meant that seven people lost their jobs, our clients lost us. The business closing has meant that our visa has been revoked and we have had to leave America. This may not be personal to them, but it is to us, their tenacity and greed has fundamentally changed our lives causing us to go into debt, bankruptcy and to be deported.
