Andre Pennigton was a judge pro tempore when my ex-wife filed an Order of Protection because I was contacting her at work. This was via phone, fax, and email. She was in direct violation of a legally binding court order regarding the contact I could have by law with my son. Therefore, I utilized both personal and work contact to encourage her to follow the court order. In the courtroom the mother acknowledged that ALL contact between herself and myself was regarding only my son. In fact, Andre turned to the mother and asked if that was true. She said: Yes. This is key. The mother acknowledged the court order and the rights I had. I asked the mother how long she had been at the same job. The answer was over 20 years. I asked how many times in 20 years had I been to her work. The answer was none. I asked when was the last time we had seen each other. She stated the last court hearing which was July of 2013. I asked in the three plus years since then had I ever been to her house. She said she had no evidence of me ever being to her house in that time period. I asked what she did if she actually did pick up the phone when I called her work or cell. She said she hung up. So, I clearly established that there had been no contact in at least three years. Andre then stated there had been a pattern of harassment. I stated it was not an order of harassment, it was an order of protection. I stated: Protection from what? There has been no contact. I then stated that the petition didn't fulfill the legal requirements for an order of harassment. An order of harassment requires two burdens of proof: There has been a pattern of contact and the contact serves no useful purpose. Even if there was a a pattern, the mother openly admitted and Andre asked her and she stated yes, that all contact was regarding my son. That is contact that serves purpose. I researched the A.R.S. on Order of Protection and Order of Harassment and Andre did not follow the law. It is my theory that Andre was pressured from the outside and did not independently make his own ruling.
