I hired Joshua Black after my employment was terminated. He was upfront and honest with me about my options. His staff did a good job keeping in touch as we waited for decisions from the unemployment office, and in the end, we were successful in winning the judge's decision that my former employer did not discharge me for misconduct and they will have to pay for my unemployment compensation.

Called their office and they were too busy to talk to me and they asked if they could call me back. Three business days later and they never called. Called back again during their business hours and they then never answered. :(

Unfortunately, the consultation fee is quite high and I found my experience left me feeling my situation was insignificant and compromised my decision to seek legal evaluation and understanding of my rights as an employee. Perhaps I am mistaken, but I would be willing to say the majority of people who are seeking legal advice and/or legal representation in employment cases are unemployed and do not have much, if any income that is unaccounted for to pay the $300 consultation fee. I understand there has got to be some upfront, filtering process to separate the non-case, typical everyday claims from the actual case-worthy claims with concrete evidence of legitimate discrimination or other wrong-doing. But I believe it can come at a lower cost or investment to the potential plaintiff than a financial investment when unlawful and/or sudden loss of income is the underlying issue why legal counsel is sought. There has got to be another way for someone to prove they are invested in a legitimate complaint with merit of a potential settlement or lawsuit resulting from documented, unlawful treatment other than the current, cut and dry, financial investment required, no-exceptions approach in place now. Take my case for example, I feel most employment attorneys would have loved to have represented me with my situation, but I was blindsided and totally unprepared for termination and loss of income as I am the sole provider of my household, which consists of myself and my two young children. We were on the brink of a financial hardship as it was and I couldn’t afford the initial fee, not to mention the retainer (who knows what that would have been if it has gotten to that point). I was given an aggressive time frame of five calendar days (which included two days for the weekend) to sign a severance agreement that waived my right to pursue a lawsuit against this company who wrongfully terminated my employment and was clearly direct retaliation for me bringing attention to a hostile working environment with unsafe working conditions including being fearful of retaliation for speaking out. All of which could be verified by multiple employees along with detailed documentation throughout including several undisputable violations of misconduct. But, I couldn’t afford to refuse signing the severance agreement as I was living paycheck to paycheck to make ends meet and had no buffer to manage a crisis situation such as this. I clearly had a case, but Mr. Black along with many other employment attorneys were unwilling to meet with me for anything less than $300 (some were even $500). Given the time constraint and my financial situation I tried my absolute hardest to be seen and have a voice. To have my case be heard and draw attention to the true principles a company operates on, to stand up for what is right and not let another giant, big money company seemingly think they can do as they please with total disregard and/or accountability of wrong-doing, that they are above the law and are untouchable. But in the end, I failed to be heard and I ultimately signed the severance agreement essentially nullifying my claim because of a consultation fee. Unfortunately, my rant gets posted here because Mr. Black’s firm was the first one I contacted and felt my case was prematurely dismissed solely on the basis of my untimely inability to secure the upfront financial investment required for a quick glance and brief discussion to preliminary evaluate my claim. However, this goes for the majority of the reputable employment attorneys out there, as it is not intended for Mr. Black's practice alone. I initially called Mr. Black's firm first because I had a referral from a mutual friend who just so happens to be a previous, quite satisfied client as well. Obviously, our friend was in a better position financially than I when Mr. Black’s services were requested. Therefore, this rating is unfair when looking at the services provided by Mr. Black to actual clients, as we didn’t reach that representation plateau.

I phoned this office on a Friday at 1:00. I was received by a messaging service stating they “strive to return calls within 30 minutes.” I never received a call back. I assumed maybe they went home early to enjoy their holiday. Nancy returned my call Monday, Labor Day. My family and I were in the pool all day. I called her back on Tuesday at 4:00. Nancy had left for the day. Greg (?) told me she would call me in the AM to schedule. I had not heard from her so I called on Wednesday at 10A and left yet another message. It’s Friday and I’ve yet to receive a call.

I am underwhelmed and unimpressed with this office which is unfortunate as I was referred. Clearly they do not need the business and have zero sense of urgency when communicating and scheduling.

I ended up drafting my own documents when they failed and only received information when I initiated calls and asked for updates.
